1. Acceptance of terms
These Terms of Use (“Terms”) govern your access to and use of the Compare ITAD website and any related services (collectively, the “Site”), operated by Xenco Labs (“we”, “us”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.
2. Editorial nature of the Site
Compare ITAD is an independent editorial directory and reference resource for IT asset disposition (“ITAD”). Content published on the Site — including vendor profiles, certification information, methodology, and risk-assessment results — is provided for informational purposes only and does not constitute legal, financial, security, or compliance advice. You are solely responsible for evaluating any vendor or decision and for engaging qualified professionals as needed.
3. Vendor information and accuracy
We aggregate information about ITAD vendors from public sources, vendor disclosures, and certifying-body registries. We exercise reasonable care, cite our sources, and operate a public corrections process at /report-correction. Despite this, the Site may contain errors, omissions, or stale information. The Site is provided “as is” without warranties of any kind, and we make no representations about the suitability, reliability, accuracy, or completeness of any vendor or content.
Inclusion in the directory is not an endorsement. Exclusion is not a criticism. Certifications and badges reflect publicly available information at the time of last verification and may change without notice.
4. Acceptable use
You agree not to:
- Scrape, crawl, or systematically download the Site in a manner that interferes with normal operation, except via our publicly available RSS feed or sitemap.
- Republish or redistribute substantial portions of Site content without our prior written permission.
- Submit false, misleading, or fraudulent listing claims, correction reports, or assessment data.
- Use the Site to harass, defame, or impersonate any person or organization, including any vendor.
- Probe, scan, or test the vulnerability of the Site, or breach any security or authentication measures.
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
5. Listing claims and submissions
Vendors may claim their listings via /claim-listing. By submitting a claim, correction, or assessment, you represent that the information you provide is accurate and that you are authorized to submit it on behalf of any organization you reference. We reserve the right to verify, edit, reject, or remove any submission for any reason consistent with our editorial standards. We may publish or otherwise use submissions in anonymized or aggregated form.
6. Sponsored content and affiliate links
The Site may include sponsored placements or affiliate links to third-party products and services. Such placements and links are clearly labeled. Sponsorship and affiliate revenue do not influence editorial content, vendor selection, or rankings. See our editorial standards for the full policy.
7. Intellectual property
All content on the Site, including text, graphics, logos, methodology, and code, is owned by Xenco Labs or its licensors and is protected by copyright, trademark, and other laws. “Compare ITAD” and the Compare ITAD wordmark are trademarks of Xenco Labs. Vendor names, logos, and certification marks are the property of their respective owners and are used for identification and informational purposes only; their use does not imply endorsement or affiliation.
You may quote short excerpts from Site content for commentary, criticism, news reporting, or research, with attribution and a link back to the source page.
8. Third-party links
The Site contains links to third-party websites. We do not control, endorse, or assume responsibility for any third-party content or practices. Your use of any third-party site is at your own risk and subject to that site's own terms.
9. Disclaimer of warranties
The Site and all content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the Site will be error-free or secure.
10. Limitation of liability
To the maximum extent permitted by law, in no event will Xenco Labs, Compare ITAD, or any of their officers, employees, contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising out of or related to the Site will not exceed one hundred U.S. dollars (US$100).
11. Indemnification
You agree to indemnify and hold harmless Xenco Labs, Compare ITAD, and their officers, employees, contributors, and affiliates from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any law, or your misuse of the Site or any content on it.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising out of or related to the Site or these Terms will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
13. Changes
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the date of the most recent change. Continued use of the Site after a change constitutes acceptance of the updated Terms.
